Terms of Service

1. Who provides Kolio

Kolio is operated by an independent developer. There is no registered legal entity behind the service yet; these terms are an agreement between you and that operator (referred to as “Kolio”, “we”, or “us”). Billing support: [email protected]. General enquiries: [email protected].

2. What the service is

Kolio is a creator growth workspace. Depending on your plan and the features enabled for your account, it includes:

• AI video generation — scripts, voiceovers, and b-roll produced with third-party AI models, plus rendering of the finished video.
• Social auto-posting — publishing and scheduling to your connected social channels through third-party posting providers.
• Tracked links and QR codes — short links and scannable codes that count clicks and scans for your campaigns.
• Hosted pages — public proof reports, media kits, surveys and polls, and lead-capture (download) pages you share by link.
• A creator directory — optional public creator profiles and an intro-request flow for people who want to reach you.

Features can change as the product evolves, and some capabilities are gated behind feature flags or specific plans.

3. Accounts and sign-in

You may sign in using a secure email link or code, a supported third-party provider, or an email address and password where password sign-in is enabled. You must provide an email address you control, safeguard every sign-in method connected to your account, and promptly report suspected unauthorised access. You are responsible for activity that happens under your account.

4. Plans, credits, and payment

Kolio offers creator plans, Sponsor Scout, and optional credit packs, all processed by Stripe:

• Subscription plans (Starter, Creator, and Pro), available monthly or annually, that include a plan credit allotment. Monthly-plan credits expire and are replaced at each monthly renewal. Annual plans grant the full year’s credits up front; unused annual credits expire when that paid annual subscription term ends. Founder pricing may apply to early cohorts. The exact price and allotment of your subscription are set by the Stripe plan you check out with; the current grid is on the pricing page.
• Pay-as-you-go credit packs. Each purchased pack expires 30 days after purchase and needs no subscription. A later pack purchase does not extend an older pack’s expiry date.
• Sponsor Scout is a separate monthly or annual public-source research subscription with one workspace, one seat, and the credit allotment shown at checkout. It does not include social publishing, media generation, owner labs, paid-ad management, or direct marketplace outreach.
• Credits are spent on metered actions (for example video generation and certain posts); the cost of each action is shown in the product before you run it.
• A free account includes signup credits and one tracked campaign so you can try the post-and-track workflow; signup credits expire 30 days after they are granted, and free-tier limits may change prospectively.

You can cancel a subscription at any time via the billing portal; cancellation takes effect at the end of the current billing period. Plan credits remain subject to the expiry date shown in your account: monthly credits expire at the monthly renewal and annual credits at the end of the paid annual term. Purchased pack credits expire 30 days after their individual purchase. Refunds are handled under the Refund Policy.

5. Acceptable use

Kolio’s creator workspace uses material you submit, while Sponsor Scout and enabled intelligence tools can retrieve bounded public-source data through disclosed providers. Kolio does not ask for social-platform session cookies, capture authenticated browsing sessions, download or repost third-party media, or copy third-party scripts. The same guardrails apply to how you may use the service:

• Do not use Kolio to scrape platforms, harvest data you are not authorized to collect, or automate actions that violate another service’s terms.
• Do not publish deceptive, infringing, or unlawful content, and do not impersonate other creators or repost their media without permission.
• Do not use capture pages, surveys, or tracked links to mislead your audience or to collect data you have no lawful basis to collect.
• Do not probe, overload, or interfere with the service or attempt to bypass its rate limits and feature gates.

AI generation, likeness, and voice

Kolio’s generative features (AI images and clips, Brand Character training, and voice cloning) come with additional rules you accept each time you use them. You are solely responsible for having the rights to any photos, audio, and prompts you submit. You may not use these features to:

• create a likeness or voice of a real, identifiable person without that person’s consent, or of any minor;
• generate sexual, sexually suggestive, or nude content, or any content sexualizing a minor;
• produce content that harasses, defames, threatens, or promotes hatred or violence against a person or group;
• impersonate a real person or organization, or create deceptive media intended to be passed off as real;
• infringe anyone’s copyright, trademark, publicity, or privacy rights.

We run automated safety checks on AI generation — a content filter on generated images and a prohibited-content blocklist on video-generation prompts — and block flagged requests, but we do not pre-screen every upload — the responsibility to have the necessary rights and consent is yours. Accounts that break these rules may be suspended and their generated media, trained characters, and cloned voices removed. 6. Your content and your responsibilities

You own the content you create with Kolio. You grant us the limited rights needed to host, process, render, and deliver it — including passing it to the third-party providers listed below — solely to run the service for you. You are responsible for having the rights to anything you upload.

What you publish is yours: you are responsible for your published content and for any legally required disclosures, including sponsored-content and affiliate-relationship disclosures required by advertising rules in the markets you post to. Kolio provides tooling, not compliance review.

7. Creator campaigns and payment status

Kolio can help a business send a campaign offer to a creator, record acceptance, collect delivery evidence, and show payment readiness. The accepted offer, campaign brief, deliverables, fee, deadline, disclosure requirements, and later written changes form the direct working agreement between that business and creator. Kolio is not the employer, agent, or representative of either party and does not promise that either party will perform.

• Kolio charges no platform commission on the creator fee: the creator fee shown in an accepted offer is the creator payout amount recorded by Kolio. Payment-processor charges, taxes, currency conversion, or destination-network charges are not silently deducted by Kolio; any charge payable by a user must be disclosed before that user confirms payment.
• A Kolio payment status is a workflow record, not an escrow, trust account, bank guarantee, or promise that funds have settled. Provider settlement, refunds, chargebacks, payout availability, identity checks, and sanctions screening are controlled by Stripe or another disclosed payment provider.
• Open offers can expire or be canceled before acceptance. After acceptance, cancellation, scope changes, missed deadlines, non-performance, and refund requests must be resolved by the parties through the recorded job and dispute flow. A dispute can place eligible Kolio payment records on hold, but Kolio cannot guarantee recovery of money already released by a provider.
• Each party is responsible for its own taxes, registrations, invoices, permits, employment classification, and legally required advertising disclosures. Marketplace and paid-ad functions are for users aged 18 or older who have authority to bind the account, campaign, brand, and payment method they use.
• Paid-ad management is not an active v11 service. If Kolio enables it in a future release, you must have authority over the ad account, creative, destination, audience, budget, beneficiary, payor, and every required local-law disclosure before using it.

8. Third-party services

Kolio is assembled from third-party infrastructure. Depending on what you use, your content and data are processed by: Stripe (payments), Supabase (authentication and database), OpenAI and Anthropic (text generation), ElevenLabs and MiniMax (voice synthesis and voice cloning), fal.ai and Runware (video, image, audio generation, and media enhancement), PostProxy (social connections, publishing, and supported engagement operations), SocialCrawl and Social Fetch (opt-in public-source research), Cloudflare R2 (media storage), and AWS (video rendering and delivery). Their availability affects ours; if a provider degrades or changes its terms, some features may be interrupted or replaced with an equivalent provider.

9. Metrics, receipts, and no guarantees

Kolio’s promise is receipts, not projections: tracked clicks, scans, sign-ups, and related metrics are reported as recorded by our systems, with basic bot filtering. Counts can differ from other analytics tools and are not audited. Kolio makes no guarantee of audience growth, sponsorships, or earnings, and nothing in the product is financial, legal, or professional advice.

10. Suspension and termination

You can stop using Kolio and request account closure at any time through Account data controls on the Member page, or via [email protected]. We may suspend or terminate accounts that violate these terms, abuse the service, or create legal risk — with notice where practical. If we terminate your account without cause, we will refund unspent purchased credits; if your account is terminated for a serious violation, credits may be forfeited.

11. Disclaimers and limitation of liability

Kolio is provided “as is” and “as available”, without warranties of uninterrupted operation or fitness for a particular purpose. To the maximum extent permitted by law, Kolio’s total liability for claims arising out of the service is limited to the amounts you paid to Kolio in the twelve months before the claim, and we are not liable for indirect or consequential losses such as lost profits, lost sponsorship deals, or lost audience. Nothing in this section limits liability that cannot lawfully be limited, or the consumer rights described in section 12.

12. Applicable law and consumer rights

These terms are governed by applicable law. Any dispute may be brought before a court that has jurisdiction under applicable law.

If you use Kolio as a consumer, you retain any mandatory protections under the consumer laws that apply to you, including protections under the laws of the country or region where you live that cannot be waived by contract. Where applicable law requires it, this includes the right to bring claims in your local courts. Nothing in these terms takes those protections away.

13. Changes to these terms

We may update these terms as the product and the law change. For material changes we will post the updated terms here with a new “Last updated” date and, where the change matters to paying accounts, notify you by email before it takes effect. Continuing to use Kolio after a change takes effect means you accept the updated terms.
